The FTC requires that environmental claims rest on competent and reliable scientific evidence, and some states require written proof files for any environmental statement on consumer goods, with records available to the public on request. A 2020 European Commission review found that 53.3% of environmental claims were unclear, misleading, or deceptive, which helped shape the EU Green Claims Directive and signals where US enforcement is heading.

The Wellness Quality Institute cannot review every microplastics dataset on the market, because not every laboratory produces data that meets WQI-CS-01. Qualification depends on accreditation tier, not brand reputation. Brands that understand these tiers before commissioning tests avoid paying for results that cannot support verification.

Independent review turns a lab report into a claim that buyers and regulators treat as credible. Self-reported results, even when based on strong testing, still look like marketing because the company grading its own homework has a clear interest in the outcome. A YouGov survey cited in packaging industry analysis found that 55% of US consumers doubt brands’ sustainability claims, and that skepticism extends to plastic language on water products.
The WQI submission process under WQI-CS-01 covers a single assessment. The company submits its independent lab dataset, method documentation, product scope, and quality-control records. The Wellness Quality Institute does not run the lab tests, which preserves independence. During review, WQI examines:

Every Wellness Quality Institute review ends with one of two clear outcomes. WQI does not issue partial approvals, provisional statuses, or ambiguous decisions.
Standard Met requires two conditions together. The dataset must satisfy all relevant technical and data-quality requirements, and the tests must show no reportable target polymer particles within the tested particle-size range and approved reporting limits. Both conditions must be satisfied because a non-detect result alone is not enough. If the reporting limits do not meet WQI requirements, the non-detect carries no evidentiary weight, regardless of what the lab report states.
Standard Not Met applies when one or more requirements remain unsatisfied. Reasons can include reportable particles, reporting limits above requirement, incomplete data, weak blanks or contamination controls, unsupported methods, missing chain of custody, laboratory qualification gaps, incomplete polymer analysis, or unclear product scope. The outcome comments on the evidence, not on the product’s overall safety or quality.
A Standard Not Met outcome remains private. It does not grant public claims, logo rights, or a registry listing, and WQI never describes it as a failed product. Companies can submit corrected or additional information later. Participating in the process creates no public downside, because many Standard Not Met outcomes reflect testing design rather than the product itself.

Understand the verification outcome process — talk to WQI
A Standard Met outcome unlocks three practical tools. The company receives a scope-locked license to use the mark “WQI Plastic-Free Pathway Verified,” a public registry listing with a unique ID, and approved claim language that matches the reviewed evidence.
The registry entry records the verified party, product scope, matrix, production or sampling period, tested particle-size range, lower method limit, polymer panel, reporting limits, testing laboratory and its accreditation, verification and expiration dates, registry ID, approved result statement, and current status. Every public verification claim must include or link to the registry ID, which allows retailers and consumers to check the claim instead of taking it on faith.
Scope lock defines how the program protects both brands and buyers. Verification applies only to the reviewed product, dataset, tested particle-size range, polymer panel, and production period. To keep that scope clear, WQI prohibits the following extensions without exception:
The verification period lasts 24 months from the sampling date of the most recent accepted dataset. Continued claim use after that date requires re-verification with current data. Expired registry entries remain visible and marked “Expired,” which keeps the public record honest over time.
Get scope-locked claim language you can stand behind — start verification
A plastic claim is unsubstantiated when language such as “plastic-free,” “microplastic-free,” “eco-friendly,” or similar phrases lacks competent and reliable scientific evidence tied to the specific product, method, and production period. The FTC standard mentioned in Step 1, competent and reliable scientific evidence, translates to proof that is objective, conducted by qualified experts, and accepted in the relevant scientific fields. A lab report alone does not meet this bar if the detection floor, polymer panel, or sampling scope remains undisclosed and unreviewed by an independent party.
Legal exposure appears at several levels. The FTC can pursue deceptive environmental claims at the federal level. Some states require written substantiation files for any environmental statement on consumer goods, and violations can qualify as misdemeanors. Civil class actions have also produced multi-million-dollar settlements when recyclability or sustainability claims lacked support. Reputational damage, including retailer delisting, negative media coverage, and consumer backlash, often arrives before formal enforcement.
Three elements separate credible independent verification from a self-reported result. First, the reviewing body must have no financial stake in the outcome and no role in the testing itself, so independence is built into the structure. Second, the review criteria must be published and anchored to a recognized external framework, which lets buyers, retailers, and regulators see the standard behind the decision. Third, the outcome must be publicly checkable through a registry or similar tool that records the product, method, scope, and period reviewed, not just a logo on a label.
A raw lab report, even a strong one, does not meet these three elements on its own. It records what the lab found but does not interpret what that finding supports or give outsiders a way to verify the claim without trusting the brand’s word. The market increasingly distinguishes between a self-asserted claim and a claim that an independent body such as The Wellness Quality Institute has reviewed and approved.
A “none detected” result on a microplastics test is a bounded statement that reflects the method’s limits. It means the lab did not find particles above the instrument’s detection floor, for the polymers in the test panel, in the specific lot sampled. Regulatory substantiation, under the FTC’s competent and reliable scientific evidence standard, requires that any claim match what this result truly supports, including its limits.
For a “none detected” result to support a market claim, the substantiation file should cover the analytical method and its validated detection range, the polymer panel, the reporting limit and whether it meets the threshold for the claim, blank data showing the lab did not introduce contamination, chain-of-custody records, and the production or sampling period. A claim that suggests broader absence than the method can detect, such as implying the product contains no plastic when the method only covers particles above 50 µm, misrepresents the evidence even if the “none detected” finding itself is accurate.
The six steps above show the path between a lab report and a defensible market claim. That path matters because it separates language that holds up under review from language that creates legal, regulatory, and reputational risk.
